Katherine is a citizen of the Secwepemc (Shuswap) Nation. Katherine has built a diverse practice providing advice and acting in disputes concerning the assertion of inherent jurisdiction and other Indigenous and treaty rights, the duty to consult, commercial matters, public inquiries (including as Assistant Commission Counsel to Ontario’s Ipperwash Inquiry, and counsel to a number of parties at Canada’s Missing and Murdered Women’s Inquiry), coroners’ inquests, employment law and workplace investigations, child welfare matters, and select criminal cases.

Katherine is the recipient of a number of awards for her innovative and passionate advocacy for human rights and the advancement of social justice, including the Minaake Award for Human Rights and Advocacy from the Native Women’s Resource Centre and the Arleen Goss Young Advocates Award from the Advocates Society.

Katherine is regularly asked by law faculties, professional associations and regulatory bodies, First Nations and Tribal Councils, and others to speak and teach in her field of practice.  She served as an adjunct professor at the University of Toronto’s Faculty of Law from 2011 to 2019.   Katherine was also a member of Ontario’s Judicial Appointments Advisory Committee from 2017 to 2020. 

Prior to joining Foglers, Katherine founded and served Indigenous clients through her own firm, Hensel Barristers, from 2011 to 2021.  During that time, she was repeatedly acknowledged by The Canadian Legal Lexpert® Directory and The Best Lawyers ™ in Canada in their rankings.  In 2021, the Globe and Mail recognized Hensel Barristers as one of the top 19 law firms in Canada practicing in the field of Aboriginal and Indigenous law. In 2023, she was named one of Canada’s Top 25 Most Influential Lawyers by Canadian Lawyer.

Jen is a partner in the Capital Markets and Securities group. Jen acts for both companies and registered dealers in a broad range of industries and has extensive expertise working with junior issuers listed on the TSX Venture Exchange and Canadian Securities Exchange.

In over 20 years of practice, she has been involved in numerous significant financings (public offerings and private placements) and complex commercial agreements for clients in the natural resource, cannabis and sports sectors. Jen also provides strategic advice on matters related to corporate governance, mergers and acquisitions and reorganizations, and has assisted clients in navigating many challenging financial and regulatory environments. She currently sits on the TSX Venture Exchange’s Ontario Advisory Committee which provides advice and recommendations to the Exchange on all policy, operational and strategic issues that are likely to have a significant impact on the public venture capital market and the role of the Exchange. 

Jen has previously contributed as a legal commentator on CBC Metro Morning and for the Globe and Mail and CBC Investigative Reports series. She is a professor at Brock University in sports law, as well as a frequent lecturer at Osgoode Hall Law School and the TSX Venture Exchange. She was recently appointed by the Ministry of the Attorney General as a part-time adjudicator on the Ontario Land Tribunal. Jen also previously served as an instructor in various continuing legal education topics and as a director and treasurer of several non-profit organizations.

Larry’s practice encompasses all aspects of commercial real estate with a particular emphasis on acquisitions, dispositions and financing of commercial, industrial and retail premises across Canada and abroad.

Throughout his career, Larry has acted as counsel in many of the largest national and international transactions involving Canadian real property. His clients include pension funds, developers, governmental organizations, lenders, institutional investors, landlords, tenants and other real property advisors.

Larry approaches all matters as a trusted advisor aiming to assist clients in realizing their business and legal goals through creative and proactive solutions.

Larry is the co-chair of Fogler’s Real Estate Group.

Gary has extensive experience working as a lawyer and advisor in various industries. He practices in a number of areas of business law, including mergers and acquisitions, private equity and venture capital, capital markets and securities, corporate finance, energy and technology.

He regularly advises Canadian and international companies, underwriters, investors and professional advisors on a range of transactions, including IPO’s, private placements, RTO’s, mergers, acquisitions and divestitures, corporate governance, compensation programs, private equity, venture capital, partnerships, joint ventures and reorganization transactions. He has managed many legal teams on significant, complex transactions.

Gary also represents a number of Indigenous Communities, and their institutions across Canada on business transactions, the formation of economic development groups and other matters focused principally on governance and wealth creation. Gary often works as co-counsel to leading national law firms specializing in Aboriginal law who focus on land claims negotiations, aboriginal and treaty rights advocacy, and consultations with government and industry. Gary provides advice on major commercial and industrial developments and impact benefit agreements throughout Canada, including in respect of infrastructure, energy transmission, renewable energy generation, logistics and transportation projects.

Gary is a repeatedly recommended lawyer in the  Canadian Legal LEXPERT™ Directory in Indigenous Law, as well as a leading lawyer in The 2024 Best Lawyers™ in Canada publication in the area of Indigenous Law.

Gary has been a member of the Board of Directors of a number of publicly traded and private corporations in various industries. Currently, he is a director of a publicly-traded wireless technology company, a private utility company providing clean energy solutions, a private managed equipment services company providing turn-key and fully financed equipment solutions in the health care sector, and a private project management and service delivery platform company providing wealth generation systems for First Nations and their service providers. He has sat on various committees of these Boards, including the Audit and Risk Management Committee, Corporate Governance Committee (Chair) and Compensation and Human Resources Committee. As a result of his legal training and past involvement in various private businesses as an investor, owner and operator, he is actively sought out as a sounding board by his clients on both legal and business matters.

Samantha is the Co-Chair of the Litigation Department.

Samantha has more than a decade of experience in business disputes, real estate disputes, and professional liability claims. She is a business-minded litigator who offers a customized litigation experience for her clients. She actively listens, examines the big picture, and proactively problem-solves.

Samantha’s practice is focused in Ontario, however, she has acted in cases in British Columbia, Alberta, and Manitoba.

Samantha is a past Chair of the civil litigation section executive of the Ontario Bar Association and is a current member of the OBA Provincial Council. Samantha has chaired and spoken at many seminars for the OBA and the Law Society of Ontario.

Samantha has an Executive MBA program from the Ivey School of Business and has published articles and hosted CPDs on the business of law.

Ian is a partner in the firm’s commercial real estate and banking and financial services groups.

In addition to representing clients in a full range of commercial real estate transactions, including the acquisition, sale and development of commercial, retail, industrial and residential properties, Ian also advises clients on issues related to the structuring of real estate transactions.

Ian has extensive experience in banking and real estate finance with an emphasis on construction and development financing, commercial mortgage lending, equity and mezzanine financing, CMBS mortgage lending, syndicated loan transactions and loan restructuring and enforcement. 

Ian is a Partner in the firm’s Litigation and Dispute Resolution Group.  He is also the Co-Chair of the Litigation Department.

Ian’s wide-ranging practice includes: commercial litigation with an emphasis on shareholder and partnership disputes, contractual disputes, insurance litigation and coverage disputes, construction litigation (including highway construction and lien matters), real estate disputes, matters before the Office of the Integrity Commissioner (Ontario) and the Mining and Lands Tribunal (Environment and Land Tribunals Ontario), professional negligence, bankruptcy and insolvency litigation, estate litigation, employment disputes, commercial landlord and tenant disputes, environmental litigation, transportation litigation and health law disputes.

Ian represents lawyers, law firms and politicians on litigation and non-litigation matters.  He also acts for individuals, corporations and estates on matters which include: shareholder and partnership disputes, oppression remedy proceedings, insurance coverage disputes, injunctive proceedings including employment-related injunctions and Mareva injunctions, defamation (libel and slander), enforcement of guarantees and theft of goods while in transit.

Ian has represented clients before the Ontario Court of Appeal, Divisional Court, Ontario Superior Court of Justice, Ontario Court of Justice, and various tribunals, including the Licence Appeal Tribunal.  Ian was counsel on one of the leading cases decided by the Court of Appeal for Ontario on the interpretation of the Tarion Addendum in residential agreements of purchase and sale, and co-counsel on one of the leading cases decided by the same court dealing with the termination of a lease between a commercial landlord and tenant. Prior to joining Fogler, Rubinoff LLP, Ian practiced commercial and insurance litigation at the Waterloo office of a national firm.

Ian has a passion for education.  During the Winter 2017 term, he was a Sessional Instructor at the University of Windsor – Faculty of Law where he taught Commercial Law – Secured Transactions. He was also an Adjunct Professor at Osgoode Hall Law School where he taught Commercial Law during the Winter 2019 term.  Ian returned to the University of Windsor – Faculty of Law in the Winter 2022 term as a Sessional Instructor where he taught Commercial Law – Secured Transactions.

Ian also conducts speaking engagements both inside and outside of the firm.

Shaun is a Partner in Fogler Rubinoff’s Tax and Wills and Estates departments. He joined the firm in 2013 after previously working at a large boutique Canadian tax firm. His practice centres on corporate and personal taxation and estate planning for owner/managers, entrepreneurs, trusts, and high-net-worth individuals.

Shaun has taken the Canadian Institute of Chartered Accountants In-Depth Tax Course as well as the CICA In-Depth HST/GST Course. He is a regular contributor to the Fogler, Rubinoff LLP tax newsletter “Dollars and Sense”, is a co-author of The Death of a Taxpayer, and produces an annual webcast for CCH Canadian Limited dealing with estate planning and taxation on death.

He is respected as trusted counsel because he provides strategic advice and creative solutions in almost every aspect of their business, across diverse industries such as staffing, building products, hospitality, sports, manufacturing and retail. Bill also provides compliance advice on competition law and the application of the Investment Canada Act.

Harriette is a partner in the firm’s business law group, with a focus on mergers and acquisitions.

She has experience working on both domestic and cross-border commercial transactions, including acquisitions, dispositions, private equity offerings, and corporate reorganizations. Harriette is also a member of the firm’s banking and financial services group, and has worked with both lenders and borrowers on secured lending transactions, acquisition and project financings, securitizations and participations.

In addition to her transactional practice, Harriette enjoys working with entrepreneurial clients starting or looking to grow their businesses, providing advice relating to structure and organization, financing considerations, shareholder and partnership arrangements, and key operating contracts.
